Arrests Over GC Property Problematic

President of the Cyprus Turkish Bar Association, Hasan Esendağlı, recently addressed concerns regarding the legal implications of recent property-related arrests carried out by South Cyprus, Yeniduzen reported. Esendağlı underscored the critical role of merit and legal security in maintaining a fair and effective judicial system. He expressed strong criticism of the South’s actions, stating that arresting individuals over property disputes in North Cyprus undermines legal and humanitarian principles.
The Greek Cypriot authorities recently arrested four individuals over disputed property rights in North Cyprus. These individuals were accused of offences related to the management, use, and sale of properties for which ownership documents were issued by the Turkish Republic of Northern Cyprus (TRNC). The TRNC is only recognised by Turkey and not by the international community or the Greek Cypriot administration, which claims jurisdiction over the whole island. The arrests have sparked controversy and criticism, particularly from the TRNC and Turkey, who view these actions as legally and diplomatically unjust.
Esendağlı pointed out that the Greek Cypriot administration’s attempts to criminalise activities occurring in North Cyprus, an area where it has no legal jurisdiction, are deeply problematic. He argued that such actions create an unjust environment of fear and insecurity for those involved. The property disputes in question involve individuals who are operating legally within the framework of the Turkish Republic of Northern Cyprus (TRNC), which is recognised by Turkey but not by the international community.
The Association President emphasised that these measures by the Greek Cypriot authorities not only disregard the legal status of the TRNC but also violate fundamental legal principles. Esendağlı noted that the arrests and associated legal proceedings are unlikely to be conducted fairly, given the existing political and legal tensions. He called for international attention and intervention to address these issues and support the rights of those affected under international law.
He also highlighted the broader implications of these actions, stressing that they exacerbate existing tensions and hinder efforts towards a comprehensive solution to the Cyprus issue. He urged the international community to recognise and address these concerns, advocating for a fair and balanced approach to the complex and long standing disputes on the island.
