IPC Awards Second Highest Compensation Amount

A Greek Cypriot, who was awarded compensation for loss of use and emotional damages by the European Court of Human Rights (ECHR) for a violation of property rights, has recently had their application to the Immovable Property Commission (IPC) resolved, Kibris Postasi reports.
This case is similar to previous property claims, such as the Loizidou case. However, unlike Loizidou’s case, this individual decided to seek resolution through the IPC, which has been recognised by the European Council and the ECHR as an effective legal remedy. The application has now been resolved.
Strengthening the IPC’s Role as an Effective Legal Remedy
The enforcement of the ECHR’s ruling is still under the supervision of the Committee of Ministers of the European Council. The fact that the Greek Cypriot’s application was resolved by the IPC is expected to positively influence the ongoing enforcement process in front of the Committee. This development also highlights that, contrary to claims by the Greek Cypriot side, the IPC’s status as an effective legal remedy has been reinforced.
Second-Largest Compensation Payment to Date
The application which was resolved concerned a significant property in Kyrenia, and the payment made to settle the claim was the second-largest ever made by the IPC.
Loizidou Case
Greek Cypriot Titina Loizidou filed a claim against Turkey with the ECHR on July 22, 1989, because her land and property remained in North Cyprus. The ECHR ruled in favour of Loizidou, ordering compensation, which was paid on December 2, 2003.*
On September 22, 2022, the EU Committee of Ministers found the measures taken by the IPC in response to the Loizidou ruling to be effective and sufficient, closing its review of the case.
*Although Turkey resisted the ruling for several years it ultimately complied. On December 2, 2003, Turkey paid Loizidou €1.1 million in compensation for the deprivation of her property rights. The payment was seen as a significant moment in Turkey’s relations with the European legal system and the ongoing political issues surrounding Cyprus. [Ed.]
